2.1. We provide IT solutions, IT support, and managed IT services, including but not limited to server provisioning, Fractional CTO/CIO services, hardware procurement, data center management, administrative support, IT staffing, and cybersecurity solutions.

features, limitations, and pricing, are provided in a Service Agreement signed
between you and TransCanada.tech. In the event of a conflict between these
Terms and a signed Service Agreement, the terms of the Service Agreement shall
govern.
 

3. Use of the Site and Services

3.1. You agree to use the Site and Services only for lawful purposes and in compliance with all applicable Canadian federal and provincial laws, regulations, and industry standards.
3.2. You are prohibited from:
  • Interfering with the operation of our Site or Services, including through unauthorized access, hacking, or distribution of malware.
  • Using our Services to engage in illegal activities, violate intellectual property rights, or compromise the security of third parties.
3.3. We reserve the right to suspend or terminate your access to our Site or Services without notice if you violate these Terms.

8.2. TransCanada.tech makes no warranties or representations
regarding third-party services.
 

9. Limitation of Liability

9.1. To the maximum extent permitted by Canadian law, TransCanada.tech
will not be liable for any indirect, incidental, consequential, or punitive
damages arising from your use of the Site or Services, even if advised of the
possibility of such damages.
9.2. Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount paid by you for the Services in the three (3) months preceding the event giving rise to the claim.
 

10. Indemnification

10.1. You agree to indemnify, defend, and hold harmless TransCanada.tech,
its affiliates, officers, employees, and agents from any claims, liabilities,
damages, or expenses arising out of your use of the Site or Services, or any
violation of these Terms.
 

11. Termination

11.1. We may terminate or suspend your access to the Site or Services at any time, for any reason, including if you violate these Terms.
11.2. Upon termination, your right to use the Site and Services will immediately cease. Any provisions of these Terms that are intended to survive termination shall remain in effect.
